1. Definitions

Throughout these Terms and Conditions, the following words carry the meanings set out below:

  • "Service" — any watch repair, inspection, regulation, or related work carried out by Pelangi, whether at the workshop or arranged remotely.
  • "User" / "You" — any individual who visits this website, submits an enquiry, or brings a watch for service.
  • "We / Us / Our" — Pelangi, operating at 41 Jalan Sultan Idris Shah, 30000 Ipoh, Perak, Malaysia.
  • "Content" — all text, images, descriptions, and materials published on this website.
  • "Agreement" — these Terms and Conditions together with any written service quotation accepted by the User.
  • "Watch" — any timepiece, movement, or associated part submitted to us for inspection or repair.

2. Acceptance of Terms

By using this website, submitting an enquiry form, or leaving a watch in our care, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using our website or services.

You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law. If you are submitting a watch on behalf of another person, you confirm that you have authority to do so.

3. Service Description

Pelangi provides specialist watch repair and maintenance services from our workshop in Ipoh, Perak. Current services include:

  • Dial Inspection and Preservation — detailed examination and documentation of dial condition, with considered advice on preservation options (RM 1,600).
  • Movement Regulation — timegrapher analysis and careful adjustment for owners whose watches are running outside their preferred daily rate (RM 660).
  • Pusher and Crown Refresh — replacement of worn pushers and crowns with attention to matching the original case finish, including gasket renewal and a basic water-resistance check (RM 1,180).

Services are available during workshop hours (Monday–Friday, 10:00–18:00; Saturday, 10:00–15:00) and by prior arrangement. We reserve the right to decline any service request at our discretion, particularly where the condition of a watch presents risk of damage during work.

4. Service Enquiries

Submitting an enquiry through the website does not constitute a booking or a service agreement. An agreement is formed only when we provide a written quotation and you confirm acceptance, either in writing or by leaving the watch in our care with explicit agreement to the quoted price.

We aim to respond to all enquiries within two working days. Response times may be longer during periods of high demand.

5. User Responsibilities

Accurate Information

You agree to provide accurate and complete information when submitting enquiries or delivering a watch. Misrepresentation of a watch's condition, ownership, or provenance may void any service agreement without refund of fees already paid.

Ownership and Authority

By leaving a watch with us, you confirm that you are the rightful owner or that you have authority from the owner to authorise repair work. Pelangi will not be liable for any dispute arising from contested ownership.

Prohibited Uses

You must not use this website to:

  • Submit false, misleading, or fraudulent information.
  • Attempt to interfere with the website's operation or security.
  • Copy, reproduce, or distribute website content without permission.
  • Use the site in any way that violates applicable Malaysian or international law.

6. Payment Terms

All prices are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise. Quoted prices are valid for 30 days from the date of issue.

Payment is due upon collection of the watch, unless an alternative arrangement has been agreed in writing. We accept cash, bank transfer, and other payment methods as displayed at the workshop. We do not extend credit facilities.

Deposits

For certain services, we may request a deposit at the time of accepting the watch. This will be communicated clearly in the quotation. Deposits are non-refundable if you cancel after work has commenced.

Abandoned Watches

If a watch is not collected within 90 days of service completion, and we are unable to reach you after reasonable attempts, we reserve the right to treat the watch as abandoned. We will make a final written attempt to contact you before taking any further steps.

7. Service-Specific Terms

Assessment Before Work

Before any service commences, we will assess the watch and provide a written quotation. Work will not begin until you have confirmed acceptance. If additional issues are discovered during work, we will contact you before proceeding.

Documentation

High-resolution photographs of the watch are taken before work begins, particularly for dial inspection services. This documentation is for your records and ours, and does not constitute an insurance valuation.

Parts

Where replacement parts are required, we will use parts appropriate to the watch's make and era where reasonably available. We do not represent that all replacement parts will be manufacturer-original unless specifically agreed.

Water Resistance

A basic water-resistance check is included with the Pusher and Crown Refresh service. This check is conducted under workshop conditions and does not carry any ongoing water-resistance assurance after the watch leaves our care.

8. Intellectual Property

All content on this website — including text, images, layout, and design — is the property of Pelangi or its content suppliers and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to view and print pages from this site for personal, non-commercial use only.

You may not reproduce, distribute, modify, or create derivative works from any website content without our prior written consent.

9. Disclaimers

Our services are provided with care and skill, but watch repair involves inherent uncertainties. We cannot predict every outcome, particularly with vintage or previously repaired pieces. The following apply:

  • We do not represent that any service will produce a specific performance outcome for any given watch.
  • Recommendations regarding patina preservation are based on our assessment at the time of inspection; we do not provide valuations or collector advice.
  • The website is provided on an "as is" basis. We make no representations about its uninterrupted availability.
  • Content on this site is for informational purposes and does not constitute professional horological or insurance advice.

10. Limitation of Liability

To the extent permitted by Malaysian law, Pelangi's total liability to you in connection with any service shall not exceed the amount paid by you for that specific service.

We are not liable for indirect, consequential, or special damages arising from service work, including loss of sentimental value, loss of use, or diminution in collector value — except where such loss results from our gross negligence or wilful misconduct.

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including supplier delays, equipment failure, or force majeure events.

11. Indemnification

You agree to indemnify and hold harmless Pelangi, its staff, and agents from any claims, damages, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misrepresentation of ownership or authority, or your use of the website in a manner not permitted by these Terms.

12. Termination

You may withdraw from a service agreement at any time before work commences by notifying us in writing. If work has not started, any deposit paid will be refunded within 14 days. Once work has commenced, deposits are non-refundable.

We may decline to proceed with or continue a service if we discover conditions that were not disclosed at the time of agreement, or if continuing the work would present unreasonable risk to the watch.

Provisions relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination of any service agreement.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or a service provided by Pelangi shall first be referred to informal resolution — please contact us at [email protected] and we will make reasonable efforts to resolve the matter within 21 days.

If informal resolution is not achieved, disputes shall be subject to the exclusive jurisdiction of the courts of Perak, Malaysia, unless both parties agree in writing to an alternative forum.

14. General Provisions

  • Entire Agreement: These Terms, together with any written quotation, constitute the entire agreement between us regarding the services described.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that or any other provision.
  • Assignment: You may not transfer your rights under these Terms to another party without our written consent. We may assign our obligations in connection with a business transfer.

15. Changes to Terms

We may revise these Terms from time to time. When we do, the "Last Updated" date at the top of this page will reflect the most recent revision. We will post a notice on the website when material changes are made. Continued use of the website or our services after changes take effect constitutes acceptance of the revised Terms.
